Limits of Liability


Baraboo Tent and Awning is not responsible for appropriate weighting or securing of umbrellas that we do not install.  It is the customer’s responsibility to purchase appropriate tables and/or weights.  

 

Baraboo Tent and Awning, Inc. SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR ECONOMIC LOSS (including, but not limited to, lost profits, down time, good will, damage to or replacement of equipment and property) resulting from breach of any warranty or from any defect in any of the products we manufacture or sell.

 


DURABRELLA LIMITED WARRANTY

 

Baraboo Tent & Awning, Inc. (BT&A) will provide repairs, or, at BT&A’s sole option, replacements, to or for a Durabrella (as defined below) during the Warranty Period (as defined below) in accordance with the following terms, conditions, and limitations.

 

Covered Product - Durabrella.  The welded aluminum frame, upright steel pole, pin, bolt, and fabric that is laced on the frame.

 

Covered Defects.  This warranty covers new fabric and its welded aluminum frame, upright pole and hardware sold by BT&A to a customer. It covers defects related to material or workmanship, which are not subject to any of the exclusions stated below, noted in a Durabrella during the Warranty Period.  Repairs of  a Durabrella (or, at BT&A's sole option, replacement of a Durabrella with the Covered Defect) will be made at BT&A's expense provided that customer complies with the terms and conditions of this warranty.

 

Warranty Period.   For the fabric cover and for the Warranty Period beginning on the date that the Durabrella is installed at the premises of the Customer and ends:

·       In one year from date of installation BT&A will furnish full fabric replacement cover with rope.

·       In one to 2 years from date of installation BT&A will furnish  fabric replacement cover with rope for  $125 plus tax.

·       In over  2 years from date of installation BT&A will furnish  fabric replacement cover with rope for  $225 plus tax.

For 5 years from date of installation of a Durabrella frame, pole, bolt, nut and pin- BT&A will furnish  full replacement of said parts. After 5 years, replacement cost is $269 plus tax.

Repair or replacement of a Durabrella under this warranty shall not start a new warranty period.

 

Obtaining Repairs.  To obtain warranty repairs, Customer must notify the BT&A of a Covered Defect within the Warranty Period and must promptly thereafter return the Durabrella, with transportation charges prepaid, to the BT&A's place of business . Exclusions.  This warranty expressly does not cover:

  • Defects caused by accident, abuse, misuse, misapplication or incorrect installation of a Durabrella, normal wear and tear, or any other event occurring after the Durabrella has been installed at the Customer's premises.
  • A Durabrella that have been modified without the express written permission of BT&A.

 

Other Terms.

  • BT&A reserves the right to use re-manufactured, refurbished, or used parts and modules in making warranty repairs.
  • THE WARRANTY SET FORTH ABOVE IS EXCLUSIVE and in lieu of all others, oral or written, express or implied. Without limitation of the foregoing statement, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY EXCLUDED.          
  • Final determination of warranty eligibility shall be made by BT&A.        
  • No modification, extension, or addition to this warranty shall be valid or binding upon BT&A, except by an express written document signed by an authorized representative of BT&A.       
  • The sole remedy under this warranty shall be the repair or replacement of defective hardware equipment under the above terms and conditions. BT&A SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR ECONOMIC LOSS (including, but not limited to, lost profits, down time, good will, damage to or replacement of equipment and property) resulting from breach of this warranty or from any defect in BT&A's products.

 

East Coast Umbrella Warranty:

 

Applies to pop-up, crank, auto tilt, and pulley umbrellas sold by East coast Umbrella sold through this web site. There is no warranty against wind damage on any East Coast umbrella.


 East Coast Umbrella cushions and umbrellas are guaranteed for one year to be free from defects in original material and workmanship.

 

 This guarantee includes the following:

 Frame, crank, tilt, mechanism, housing, rib cleats, valance clamps, cap, zipper, stuffing and fabric cover.

 

 This guarantee does not cover the following:  Product failure caused by unreasonable use and/or care, acts of nature (i.e. wind/storm damage). If a defect in original material or workmanship does occur during the warranty period, East Coast Umbrella will repair or replace at its discretion, the product without charge. If a problem occurs after the warranty period you may request a repair or replacement quote upon inspection of the damage. Freight charges both ways will be your responsibility.


Most damage to umbrellas is attributed to wind damage.  Wind damage is not covered under our warranty. East Coast Umbrella highly recommends that umbrellas are secured with a sufficiently weighted base with tightening screw. No umbrella should be left unattended in the open position. During windy conditions, it is recommended that umbrellas be closed when not attended.
